General terms of sale

Preamble

These general terms and conditions of sale (hereinafter the "General Conditions" or "GTC") apply to any purchase made by an individual residing in France (hereinafter the "Customer"), on the Website: https://green-ethnies.fr (hereinafter the "Site") from GREEN ETHNIES SA, a public limited company, registered with the Trade Register of the Canton of Vaud under number CHE-476.958.222, with its registered office at Rue du Bourg 17, 1095 LUTRY, SWITZERLAND, Tel +800 0310 0510; e-mail: info@greenethnies.com (hereinafter "GREEN ETHNIES").

GREEN ETHNIES is a Swiss company specializing in natural dietary supplements that markets Products based on natural plant extracts as part of a dietary supplement.

These general terms and conditions of sale are intended to govern the sale and Delivery of Products ordered from GREEN ETHNIES via the Site.

They are accessible and printable at any time via a hyperlink available in the footer of the Site.

IMPORTANT

Any order placed on the Site necessarily implies the Client's unconditional acceptance of these general conditions

 

Article 1. Definitions

The terms used below have, in these General Conditions, the following meaning:

  • Client”: designates the contracting party of GREEN ETHNIES, who guarantees to have the status of consumer as defined by French law and jurisprudence. As such, it is expressly provided that the Client acts outside of any habitual or commercial activity
  • “Order”: designates the purchase of Products by a Client on the Site.
  • Account”: designates the space dedicated to the Client associated with all data provided by the Client, hosted on the Site. Access to the Account is done using the Client's Identifiers.
  • Identifiers”: designates the email address and password chosen by the Client, necessary to access their Account on the Site.
  • Delivery”: designates the first presentation of the Products ordered by the Client at the delivery address indicated during the Order.
  • Products”: designates all Products marketed by GREEN ETHNIES on the Site.
  • Territory”: designates Metropolitan France

Article 2. Purpose

These General Conditions govern the sale of Products by GREEN ETHNIES via the Site.

The Client is clearly informed and acknowledges that the Site is intended only for consumers.

Article 3. Acceptance of the general conditions

The Client undertakes to carefully read these General Conditions and accept them before proceeding with the payment of a Product Order placed on the Site.

These General Conditions are referenced at the bottom of each page of the Site by means of a link and must be consulted before placing the Order. The Client is invited to carefully read, download, print the General Conditions and keep a copy.

GREEN ETHNIES advises the Client to read the General Conditions with each new Order, the latest version of said Conditions applying to any new Product Order.

By clicking on the "Add to cart" button to place the Order and then on the second "Payment" button to confirm said Order, the Client acknowledges having read, understood, and accepted the General Conditions without limitation or condition.

Article 4. Purchase of Products on the SITE

To be able to purchase a Product, the Client must be at least 18 years old and have legal capacity.

To purchase a Product on the Site, the Client must be registered or order as a guest.

Article 4.1. Registration procedure

Any Client has the option to register during their first visit to the Site in order to create an Account. Client registration on the Site is free.

For the purpose of opening their Account, the Client must:

  • Fill out the form provided for this purpose and provide all required information, including their last name, first name, and email address.
  • Choose their password, which together with the email address, will constitute their Identifiers. It is recommended to change the password regularly.

Any incomplete registration will not be validated, which the Client acknowledges and accepts.

The information that the Client provides to GREEN ETHNIES during registration must be complete, accurate, and up-to-date. GREEN ETHNIES reserves the right to ask the Client to confirm, by any appropriate means, their identity, eligibility, and the information provided.

Registering a Client automatically opens an Account in their name, which allows them to manage Product Orders.

At the end of this process, the Client will receive a confirmation email of the registration.

Clients guarantee that all information they provide in the registration form is accurate, up-to-date, and sincere, and is free from any misleading character.

They commit to promptly updating this information in their Account in case of changes, so that it always meets the aforementioned criteria.

Clients are informed and agree that the information entered for the purpose of creating or updating their Account serves as proof of their identity. The information entered by Clients binds them upon validation.

Clients can access their Account at any time after logging in using their Identifiers.

The Account allows the Client to view their Orders placed on the Site.

The Client can also contact GREEN ETHNIES' sales department at any time by email, at info@greenethnies.com or via the contact form to obtain information about the status of their Order.

GREEN ETHNIES is nevertheless committed to securely retaining all contractual elements whose retention is required by law or applicable regulations.

Article 4.2. Management of Identifiers

The Customer will be solely responsible for the use of their Identifiers or actions taken through their Account.

If a Customer discloses or uses their Identifiers contrary to their intended purpose, GREEN ETHNIES may then terminate access to the Account without notice or compensation.

Under no circumstances shall GREEN ETHNIES be held responsible in the event of identity theft of a Customer. Any access and actions carried out from a Customer's Account will be presumed to have been performed by that Customer, insofar as GREEN ETHNIES is not obligated and does not have the technical means to verify the identity of persons accessing the Account.

Any loss, diversion, or unauthorized use of a Customer's Identifiers and their consequences are the sole responsibility of the Customer, who must notify GREEN ETHNIES without delay by email sent to the following address: info@greenethnies.com .

Article 4.3. Unsubscription

The Customer can close their Account at any time by sending an email to the address: info@greenethnies.com . GREEN ETHNIES will proceed as soon as possible to deactivate the Account and will send the Customer an email confirming the closure.

In the case of ongoing Orders, these must be paid for by the Customer and delivered by GREEN ETHNIES.

 

Article 5. Order

Article 5.1. Product characteristics

GREEN ETHNIES undertakes to present the essential characteristics of the Products and the mandatory information that the Customer must receive under applicable law.

 

These characteristics and information appear on the product sheets available on the Site and include in particular the description, ingredients, usage precautions, and the price of the Products.

The Customer agrees to carefully read this information before placing an Order on the Site.

Article 5.2. Ordering procedure

Product Orders are placed directly on the Site. To place an Order, the Customer must follow the steps described below (please note, however, that depending on the Customer's starting page, the steps may vary slightly).

5.2.1. Selection of Products and purchase options

The Customer must select the Product(s) of their choice by clicking on the relevant Product(s) and choosing the desired characteristics and quantities. Once the Product is selected, the Product is placed in the Customer's cart. The Customer can then add as many Products to their cart as they wish.

5.2.2. Orders

Once the Products have been selected and placed in their cart, the Customer must click on the cart and verify that the contents of their Order are correct and click on "Payment".

If the Client has not yet done so, they will then be invited to identify themselves or register or order as a guest.

Once the Client has validated the cart content and has identified / registered, an online form will be displayed to them, automatically completed and summarizing the applicable price and taxes.

At this stage, the Client can also subscribe to our newsletter to be informed of news, new products, and exclusive offers from GREEN ETHNIES.

The Client is also invited to complete their delivery address.

At the next step, the Client must also select the delivery method.

At this stage, a new online form will be displayed to them, automatically completed and summarizing the Products, applicable prices and taxes, as well as delivery fees.

The Client is invited to verify the content of their order (including the quantity, characteristics, and references of the ordered Products, the delivery address, the billing address, the payment method, and the price) before validating its content.

The Client can then proceed to pay for the Products by following the instructions on the Site and provide all the information necessary for billing and Delivery of the Products.

The Client has the option to indicate a billing address different from the delivery address.

At this stage, the Client still has the possibility to modify their personal information and their Order.

5.2.3. Acknowledgment of Receipt

Once all the steps described above are completed, a page appears on the Site to acknowledge receipt of the Client's Order. The order acknowledgment is automatically sent to the Client by email, provided that the email address provided through the registration form is correct.

It is specified that the Order summary as well as the confirmation email can be printed by the Client.

5.2.4. Billing

During the ordering process, the Client must enter the billing information (the (*) sign will indicate the mandatory fields that must be completed for the Client's Order to be processed by GREEN ETHNIES).

The Client must also specify the chosen payment method.

Neither the order form that the Client completes online, nor the order acknowledgment that GREEN ETHNIES sends to the Client by email, constitute an invoice. Regardless of the ordering or payment method used, the Client will receive the original invoice upon Delivery of the Products, on the package.

Article 5.3. Order Date

The order date is the date on which GREEN ETHNIES confirms the order on the Site. The deadlines indicated on the Site only start from this date.

Article 5.4. Prices

For all Products, the Customer will find on the Site prices displayed in euros including all taxes, as well as applicable delivery charges (depending on the weight of the package, excluding packaging and gifts, the Delivery address, and the carrier or chosen mode of transport).

Prices include in particular the value-added tax (VAT) at the rate in effect on the date of the Order. Any change in the applicable rate may impact the price of Products from the effective date of the new rate.

The applicable VAT rate is expressed as a percentage of the value of the Product sold.

The prices from GREEN ETHNIES suppliers are subject to change. Consequently, the prices indicated on the Site may change. They may also be modified in case of special offers or sales.

The prices indicated are valid, except for gross errors. The applicable price is the one indicated on the Site on the date the Order is placed by the Customer.

Article 5.5. Product availability

GREEN ETHNIES commits to deliver the Product on the date or within the timeframe indicated to the Customer, unless the parties have agreed otherwise.

The unavailability of a Product is generally indicated on the page of the concerned Product. Customers can register to receive an email informing them that the Product is available again.

In any case, if the unavailability was not indicated at the time of the Order, GREEN ETHNIES commits to inform the Customer without delay if the Product is unavailable.

If the Customer decides to cancel their Order of unavailable Products, they will receive a refund of all amounts paid for the unavailable Products no later than fourteen (14) days following the date on which the contract was terminated.

Article 6. Right of withdrawal

The terms of the right of withdrawal are provided in the « withdrawal policy », policy available in Annex 1 of these terms.

In accordance with Article L.221-28 of the Consumer Code, it is reminded that the right of withdrawal does not apply to GREEN ETHNIES Products which:

- are perishable quickly;

- have been opened or unsealed and cannot be returned for hygiene or health protection reasons (as well as any edible Product whose packaging or container has been opened cannot be subject to a right of withdrawal).

Article 7. Payment

 

Article 7.1. Payment methods

The Customer can pay for their Products online on the Site using the methods offered by GREEN ETHNIES, that is to say by:

  • Bank card (Visa, Mastercard, American Express). Payments are secured through the Mollie solution.
  • Paypal.
  • Apple Pay.

The Customer guarantees to GREEN ETHNIES that they hold all the required authorizations to use the chosen payment method.

GREEN ETHNIES will take all necessary measures to ensure the security and confidentiality of data transmitted online as part of online payment on the Site.

It is specified that all payment information provided on the Site is transmitted to the online payment solution and is not processed on the Site.

Article 7.2. Payment date

In the case of a single payment by credit card, the Client's account will be debited as soon as the Product Order is placed on the Site.

If the Client decides to cancel their Order of unavailable Products, the refund will be made in accordance with the last paragraph of article 5.5 of these General Conditions.

Article 7.3. Refusal of payment

If the bank refuses to debit a card or other means of payment, the Client must contact GREEN ETHNIES Customer Service to pay the order by any other valid and accepted means of payment by GREEN ETHNIES.

In the event that, for any reason whatsoever, opposition, refusal or other, the transmission of the money flow due by the Client proves impossible, the Order will be canceled and the sale automatically terminated.

Article 8. Proof and archiving

Any contract concluded with the Client corresponding to an order amounting to more than 120 euros including tax will be archived by GREEN ETHNIES for a period of ten (10) years in accordance with article L. 213-1 of the Consumer Code.

GREEN ETHNIES agrees to archive this information to ensure transaction tracking and to produce a copy of the contract at the Client's request.

In case of dispute, GREEN ETHNIES will have the possibility to prove that its electronic tracking system is reliable and guarantees the integrity of the transaction.

Article 9. Transfer of ownership

GREEN ETHNIES remains the owner of the Products delivered until full payment by the Client.

The above provisions do not prevent the transfer to the Client, at the time of receipt by them or by a third party designated by them other than the carrier, of the risks of loss or damage to the Products subject to the retention of title, as well as the risks of damage they may cause.

 

Article 10. Delivery

The terms of Delivery of the Products are provided in the “delivery policy” referred to in Annex 2 of these terms.

 

Article 11. Packaging

Products will be packaged in accordance with current transport standards to ensure maximum protection for the Products during Delivery as well as their preservation at the proper temperature.

Clients agree to comply with the same standards when returning Products under the conditions set out in Annex 1 – Withdrawal Policy.

 

Article 12. Guarantees

Apart from the commercial guarantees that GREEN ETHNIES may offer for certain Products, every Client benefits from "legal" guarantees for all Products, which are detailed below.

Article 12.1. Guarantee of conformity

Article L. 217-4 of the Consumer Code : « The seller delivers a good that complies with the contract and is liable for non-conformity defects existing at the time of delivery.
It also covers non-conformity defects resulting from packaging, assembly instructions or installation when this has been charged to it by the contract or carried out under its responsibility
».

Article L.217-5 of the Code of consumption : « The good complies with the contract:
1° If it is suitable for the usual use expected of a similar good and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or their representative, notably in advertising or labeling;
2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter."

 

GREEN ETHNIES may be liable for non-conformity defects existing at the time of delivery and for non-conformity defects resulting from the packaging, when this has been charged to it or carried out under its responsibility.

 

The action resulting from the non-conformity defect is prescribed by two (2) years from the delivery of the Product. (Article L.217-12 of the Consumer Code)

In case of non-conformity, the Client may request the replacement or repair of the Product, at their choice. However, if the cost of the Client's choice is manifestly disproportionate compared to the other possible option, considering the value of the Product or the importance of the defect, GREEN ETHNIES may proceed with a refund, without following the option chosen by the Client.

In the event that a replacement or repair is impossible, GREEN ETHNIES undertakes to refund the price of the PRODUCT within thirty (30) days upon receipt of the returned PRODUCT and in exchange for the return of the Product by the CLIENT to the following address GREEN ETHNIES, Rue du Bourg 17, 1095 LUTRY, SWITZERLAND.

Finally, the Client is exempt from proving the existence of the Product's non-conformity defect during the twenty-four (24) months following the delivery of the Product except for second-hand goods for which this period is set at six (6) months. (Article L. 217-7 of the Consumer Code).

 

It is specified that this legal guarantee of conformity applies independently of any commercial warranty granted, if applicable, on the Products.

Article 12.2. Warranty against hidden defects

 

GREEN ETHNIES is liable for the warranty against hidden defects of the sold Product that make it unfit for the intended use, or that so diminish this use that the Client would not have acquired it, or would have paid a lower price, if they had known about them. (Article 1641 of the Civil Code)

 

This warranty allows the Client who can prove the existence of a hidden defect to choose between a refund of the Product price if it is returned and a partial refund if the Product is not returned.

 

In the event that replacement or repair is impossible, GREEN ETHNIES undertakes to refund the price of the Product within thirty (30) days upon receipt of the returned Product and in exchange for the return of the Product by the Client to the following address: GREEN ETHNIES, Rue du Bourg 17, 1095 LUTRY, SWITZERLAND.

The action resulting from hidden defects must be brought by the Client within two (2) years from the discovery of the defect. (Paragraph 1st of article 1648 of the Civil Code)

 

Article 13. Liability

The liability of GREEN ETHNIES can in no case be engaged in the event of non-performance or poor performance of contractual obligations attributable to the Client, notably during the entry of their Order.

GREEN ETHNIES cannot be held responsible, nor considered to have failed under these terms, for any delay or non-performance when the cause of the delay or non-performance is related to a case of force majeure as defined by the case law of French courts and tribunals.

It is also specified that GREEN ETHNIES does not control websites that are directly or indirectly linked to the Site. Consequently, it excludes all liability for the information published there. Links to third-party websites are provided for informational purposes only and no guarantee is given regarding their content.

 

Article 14. FORCE MAJEURE

The liability of GREEN ETHNIES cannot be invoked if the non-performance or delay in performing one of its obligations described in these GTC results from a case of force majeure.

There is force majeure in contractual matters when an event beyond the debtor's control, which could not reasonably have been foreseen at the time of the contract's conclusion and whose effects cannot be avoided by appropriate measures, prevents the debtor from performing their obligation.

If the impediment is temporary, the performance of the obligation is suspended unless the resulting delay justifies the termination of the contract. If the impediment is permanent, the contract is automatically terminated and the parties are released from their obligations under the conditions provided in articles 1351 and 1351-1 of the Civil Code.

In the event of the occurrence of one of the aforementioned events, GREEN ETHNIES will endeavor to inform the Client as soon as possible.

Article 15. Personal Data

You have the option to register for free on the BLOCTEL telephone solicitation opposition list to no longer be solicited by phone by a professional with whom you do not have an ongoing contractual relationship, in accordance with law n°2014-344 of March 17, 2014, relating to consumption. Any consumer can register for free on this list.

GREEN ETHNIES collects personal data about its Clients on the Site, including through cookies. Clients can disable cookies by following the instructions provided by their browser.

The data collected by GREEN ETHNIES is notably used to process Orders placed on the Site, manage the Client's Account, analyze Orders, and, if the Client has expressly chosen this option, send commercial prospecting mails, newsletters, promotional offers, and/or information about special sales, unless the Client no longer wishes to receive such communications from GREEN ETHNIES.

Clients can unsubscribe at any time by accessing their Account or by clicking on the hyperlink provided for this purpose at the bottom of each offer received by email.

The Client is invited to consult the GREEN ETHNIES Privacy Policy accessible at the following address: https://green-ethnies.fr/pages/politique-confidentialite which will provide more information regarding the protection of personal data, the processing carried out via the Site, and the methods for exercising rights.

 

Article 16. Claims – CUSTOMER SERVICE

GREEN ETHNIES provides the Client with a "Customer Telephone Service" at the following number: +800 0310 0510 (toll-free number) available Monday to Friday from 9:00 AM to 5:00 PM.

Any written claim from the Client must be sent by mail to: GREEN ETHNIES, Rue du Bourg 17, 1095 LUTRY, SWITZERLAND, or by email to the following address: info@greenethnies.com .

 

Article 17. Intellectual Property

All visual and sound elements of the Site, including the underlying technology used, are protected by copyright, trademark law, and/or patents.

These elements are the exclusive property of GREEN ETHNIES. Anyone who edits a website and wishes to create a direct hyperlink to the Site must obtain authorization from GREEN ETHNIES.

This authorization from GREEN ETHNIES will in no case be granted definitively. This link must be removed at the request of GREEN ETHNIES. Hyperlinks to the Site that use techniques such as framing or in-line linking are strictly prohibited.

Any representation or reproduction, in whole or in part, of the Site and its content, by any means whatsoever, without the prior express authorization of GREEN ETHNIES, is prohibited and will constitute an infringement punishable under the provisions of the Intellectual Property Code.

Acceptance of these GTC constitutes recognition by the Client of GREEN ETHNIES' intellectual property rights and commitment to respect them.

 

Article 18. Validity of the General Conditions

Any change in the legislation or regulations in force, or any decision of a competent court invalidating one or more clauses of these General Conditions shall not affect the validity of these General Conditions. Such a change or decision does not authorize Clients to disregard these General Conditions.

 

Article 19. Modification of the General Conditions

These General Conditions apply to all purchases made online on the Site, as long as the Site is available online.

The General Conditions are precisely dated and may be modified and updated by GREEN ETHNIES at any time. The applicable General Conditions are those in effect at the time of the order.

Changes made to the General Conditions will not apply to Products already purchased.

 

Article 20. Jurisdiction and applicable law

THE PRESENT GENERAL CONDITIONS AS WELL AS THE RELATIONSHIPS BETWEEN THE CLIENT AND GREEN ETHNIES ARE GOVERNED BY FRENCH LAW.

IN CASE OF DISPUTE, ONLY FRENCH COURTS SHALL HAVE JURISDICTION.

However, prior to any recourse to the arbitral or state judge, the Client is invited to contact the GREEN ETHNIES complaints service.

If no agreement is reached or if the Client proves to have previously attempted to resolve the dispute directly with GREEN ETHNIES through a written complaint, an optional mediation procedure will then be proposed, conducted in a spirit of loyalty and good faith with a view to reaching an amicable agreement upon the occurrence of any conflict relating to this contract, including regarding its validity.

The party wishing to initiate the mediation process must first inform the other party by registered letter with acknowledgment of receipt, indicating the elements of the conflict.

Since mediation is not mandatory, the Client or GREEN ETHNIES may withdraw from the process at any time.

IN THE EVENT THAT MEDIATION FAILS OR IS NOT CONSIDERED, THE DISPUTE THAT MAY HAVE GIVEN RISE TO MEDIATION WILL BE REFERRED TO THE COMPETENT JURISDICTION DESIGNATED ABOVE.

ANNEX 1

WITHDRAWAL POLICY

In accordance with Article L.221-28 of the Consumer Code, it is reminded that the right of withdrawal does not apply to GREEN ETHNIES Products which:

- are perishable quickly;

- have been opened or unsealed and cannot be returned for hygiene or health protection reasons (as well as any edible Product whose packaging or container has been opened cannot be subject to a right of withdrawal).

Principle of withdrawal

The Customer generally has the right to withdraw by returning or handing back the Product to GREEN ETHNIES, without giving any reason.

 

For this, the Product must be returned or handed back no later than fourteen (14) days after communicating the decision to withdraw, unless GREEN ETHNIES offers to collect the Product itself.

Withdrawal period

The withdrawal period expires fourteen (14) days after the day on which you or a third party other than the carrier and designated by you takes physical possession of the item.

If the Customer has ordered several Products via a single Order resulting in multiple deliveries (or in the case of an Order of a single Product delivered in several batches), the withdrawal period will expire fourteen (14) days after the day on which you or a third party other than the carrier and designated by you takes physical possession of the last item.

In the case of delivery of the Product in several batches, the withdrawal period will expire fourteen (14) days after the day on which you or a third party other than the carrier and designated by you takes physical possession of the last batch or piece.

Notification of the right of withdrawal

To exercise the right of withdrawal, the Customer must notify their decision to withdraw by means of an unambiguous statement (for example, a letter sent by post or email) to: GREEN ETHNIES, Rue du Bourg 17, 1095 LUTRY, SWITZERLAND or info@greenethnies.com .

To meet the withdrawal deadline, the Client must send their communication regarding the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

In the event of withdrawal by the Client, GREEN ETHNIES undertakes to refund all amounts paid, including delivery costs, without undue delay, and at the latest within fourteen (14) days from the date it is informed of the Client's decision to withdraw (Article L.221-24 of the Consumer Code).

Unless it offers to collect the Products itself, GREEN ETHNIES may delay the refund until it has received the Products or the consumer has provided proof of shipment of the Products, the date considered being the earlier of these events.

GREEN ETHNIES will refund using the same payment method that the Client used for the initial transaction, unless the Client expressly agrees to use another payment method and provided that the refund does not incur any fees for the Client.

Return procedures

In any case, the Client must return the item to GREEN ETHNIES, Rue du Bourg 17, 1095 LUTRY, SWITZERLAND, no later than fourteen (14) days after communicating their decision to withdraw from this contract.

This deadline is considered met if the Client returns the item before the expiration of the fourteen (14) day period.

Return costs

The Client must bear the direct costs of returning the item.

If the item, due to its nature, cannot normally be returned by mail and was delivered to the Client's home at the time of contract conclusion, we will collect the item at our own expense.

Condition of the returned item

The Product must be returned according to GREEN ETHNIES' instructions and must include all delivered accessories.

The Client's liability is only engaged with regard to the depreciation of the item resulting from handling other than those necessary to establish the nature, characteristics, and proper functioning of this Product.

Exclusions from the right of withdrawal

The right of withdrawal is excluded in the following cases:

  • Provision of services fully performed before the end of the withdrawal period and whose execution started after the consumer's prior express consent and express waiver of their right of withdrawal
  • Supply of goods or services whose price depends on fluctuations in the financial market
  • Supply of goods made according to the Client's specifications or clearly personalized
  • Supply of goods likely to deteriorate or expire rapidly
  • Supply of sealed audio or video recordings or software that have been unsealed after delivery
  • Newspaper, periodical, magazine (except subscription contract)
  • Provision of accommodation services other than for residential purposes, transport of goods, car rental, catering or services related to leisure activities if the offer specifies a specific date or period of performance
  • Supply of goods which by their nature are inseparably mixed with other items
  • Supply of sealed goods that cannot be returned for health protection or hygiene reasons and that have been unsealed by the Client after delivery
  • Supply of alcoholic beverages whose price was agreed upon at the time of the conclusion of the sales contract, whose delivery can only be made after 30 days and whose actual value depends on market fluctuations beyond the seller's control
  • Supply of non-materialized digital content if the execution has started with the consumer's prior express consent, who has also acknowledged that they will thus lose their right of withdrawal
  • Urgent maintenance or repair work to be carried out at the consumer's home and expressly requested by them, limited to spare parts and work strictly necessary to respond to the emergency
  • Contracts concluded during a public auction

 

ANNEX 2:

DELIVERY POLICY

Delivery area

The Products offered can only be delivered within the Territory.

It is impossible to place an Order for any delivery address located outside this Territory.

It is also the Client's responsibility to inquire with local authorities about any import restrictions on the Products they intend to order.

In case of package return due to customs reasons, no refund will be made.

Products are shipped to the delivery address(es) that the Customer has indicated during the ordering process.

Shipping Time

The times to prepare an order and then issue the invoice, before shipping Products in stock, are mentioned on the Site. These times exclude weekends or public holidays.

An email will be automatically sent to the Customer at the time of shipment of the Products, provided that the email address in the registration form is correct.

Delivery Times & Fees

During the ordering process, GREEN ETHNIES indicates to the Customer the possible delivery times and shipping options for the purchased Products.

Shipping costs are calculated based on the delivery method, the weight of the package, and the Delivery address.

The amount of these costs will be payable by the Customer in addition to the price of the purchased Products.

Delivery Terms

The following delivery methods are available:

  • "Standard" within 4 to 8 days;
  • "Fast" within 2 to 3 days.

Deliveries are carried out by Swiss Post.

DELIVERY Issues

The Customer is informed of the delivery date set at the time they choose the delivery options, at the end of the online ordering process, before confirming the Order.

It is specified that deliveries will be made within a maximum of thirty (30) days. Otherwise, the Customer must formally request GREEN ETHNIES to deliver within a reasonable time and in case of non-delivery within this period, they may terminate the contract.

GREEN ETHNIES will refund, without undue delay from the receipt of the termination letter, to the Customer the total amount paid for the Products, including taxes and delivery fees, using the same payment method that the Customer used to purchase the Products.

GREEN ETHNIES is responsible until the Product is Delivered to the Customer. It is reminded that the Customer has a period of three (3) days to notify the carrier of any damage or partial loss observed during Delivery.
